1. Introduction

These Terms of Service (“Terms”) govern your use of the [App Name] mobile application (“App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.   

2. Use of the App

  • You may use the App for personal, non-commercial purposes only.

  • You may be able to create or upload content to the App, such as flashcards or study sets.
  • You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, perform, display, and distribute your content for the purpose of providing the App.
  • You are responsible for the content you create or upload. You represent and warrant that your content does not infringe the rights of any third party.

4. Intellectual Property

  • The App and its content, including but not limited to the software, design, text, graphics, and logos, are protected by intellectual property laws.
  • You may not use any of our intellectual property without our prior written consent.   

5. Disclaimer of Warranties

  • THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIEDWARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.   
  • WE MAKE NO WARRANTY THAT THE APP WILL BE ERROR-FREE, RELIABLE, OR CONTINUOUSLY AVAILABLE.   

6. Limitation of Liability

  • IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE APP.   

7. Indemnification

  • You agree to indemnify, defend, and hold harmless edvocapp and its affiliates from and against any and all claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App or your violation of these Terms.   

8. Changes to the Terms

  • We may update these Terms from time to time. We will notify you of any material changes by posting a notice on the App or by other means. Your continued use of the App after such notice constitutes your acceptance of the modified Terms.

  • These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction].
